Terms of Service

These Terms of Service (“Terms”) are an agreement between you and Viewed (“Viewed,” “we,” “us,” or “our”). They govern your use of the Viewed mobile app, the website at viewedapp.com, and any related features or services we offer (together, the “Service”).

By creating an account, accessing, or using the Service, you agree to these Terms and to our Privacy Policy. If you don’t agree, please don’t use the Service.

You must be at least 13 years old to use Viewed. If you live in a place that requires a higher age to use online services like Viewed without parental consent, you must meet that age or have your parent or guardian’s permission.

If you are under the age of legal majority where you live, your parent or guardian must review and agree to these Terms on your behalf.

You may not use Viewed if we have previously suspended or banned your account, or if you are prohibited from using the Service under applicable law.

Some features, like saving titles, rating, reviewing, following people, and chatting, require an account. When you create one, you agree to:

• Provide accurate information and keep it up to date.
• Choose a username that doesn’t impersonate anyone or infringe anyone’s rights.
• Keep your login credentials secure and not share your account with others.
• Tell us promptly if you believe someone has accessed your account without permission.

You are responsible for activity that happens under your account. We may reclaim or change usernames when necessary, for example to address impersonation or trademark concerns.

Viewed lets you create and share content, including reviews, ratings, lists, notes, comments, chat messages, debate and discussion posts, community posts, profile details, and images (“Your Content”).

You own Your Content. To operate the Service, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, adapt (for example, to format or resize it), publish, display, and distribute Your Content in connection with providing, promoting, and improving Viewed. This license is limited to those purposes.

Who can see Your Content depends on where you post it and on your settings. Private content, such as personal notes, is not shown to other users. Content you share publicly, such as public reviews and lists, may be visible to anyone using Viewed.

The license ends when you delete Your Content or your account, except where:

• others have already shared or interacted with it (for example, a reply quoting your post or a message you sent in a chat), or
• we need to keep it for a limited time in backups, or to comply with legal obligations, resolve disputes, or enforce these Terms.

You are responsible for Your Content. You confirm that you have the rights needed to post it and that it doesn’t violate these Terms or anyone else’s rights.

Viewed is a place to celebrate and argue about the stories we love. Strong opinions are welcome. Personal attacks are not. When using Viewed, you agree not to:

• Harass, bully, threaten, or intimidate anyone, or encourage others to do so.
• Post hate speech or content that attacks people based on race, ethnicity, national origin, religion, sex, gender identity, sexual orientation, disability, or other protected characteristics.
• Post sexually explicit content, content that sexualizes minors, graphic violence intended to shock, or content promoting self-harm.
• Share someone else’s private information without their permission.
• Impersonate any person or organization, or misrepresent your affiliation with them.
• Spam, run scams, manipulate ratings, reviews, leaderboards, or XP, or use fake or automated accounts.
• Share links to pirated content or otherwise infringe copyrights, trademarks, or other rights.
• Post major spoilers without using the spoiler tools Viewed provides, where available.
• Scrape, crawl, or collect data from the Service without our written permission.
• Interfere with or disrupt the Service, probe for vulnerabilities without authorization, or bypass any security or access controls.
• Use Viewed for anything illegal.

If you see something that breaks these rules, please report it using the in-app tools or through our support page.

We may review, hide, remove, or restrict content, and warn, limit, suspend, or ban accounts, if we believe they violate these Terms or create risk for Viewed, our users, or others. We aren’t obligated to monitor all content, and we can’t review everything, but we take reports seriously.

If you believe we made a mistake moderating your content or account, contact us and we’ll take another look.

Copyright complaints

If you believe content on Viewed infringes your copyright, email us at support@noxxstudios.com with a description of the work, where the content appears on Viewed, your contact details, and a statement that you have a good-faith belief the use isn’t authorized. We will respond to valid notices and may remove the content and take action against repeat infringers.

Viewed displays information about movies, TV shows, and anime, such as titles, posters, images, trailers, cast, release dates, and descriptions. Some of this information comes from third-party sources, and its accuracy and availability are not guaranteed.

Viewed is a place to track and discuss media. We do not host, sell, or stream movies, shows, or anime. Titles, artwork, and trademarks belong to their respective owners, and their appearance on Viewed doesn’t mean those owners endorse or are affiliated with Viewed.

The Service may link to or embed third-party websites, videos, or services. We don’t control them and aren’t responsible for their content or practices. Your use of them is subject to their own terms and policies.

Viewed includes features such as experience points (XP), levels, badges, achievements, leaderboard rankings, and cosmetic items like titles, colors, fonts, and profile badges (together, “Progression Items”).

• Progression Items are a license to use a feature within Viewed. They are not property, have no monetary value, and can’t be sold, transferred, or exchanged for cash.
• We may adjust how Progression Items are earned, displayed, or calculated, reset leaderboards, or retire items over time.
• We may remove Progression Items earned through cheating, exploits, or other violations of these Terms.

If we offer paid features or purchases in the future, any additional terms, including pricing and refund information, will be shown to you before you buy. Purchases made through the Apple App Store or Google Play are also subject to those stores’ terms.

The Service, including the Viewed name, logo, app design, software, and features, is owned by Viewed and protected by intellectual property laws. Apart from the limited right to use the Service under these Terms, we don’t grant you any rights to our intellectual property.

You may not copy, modify, distribute, sell, reverse engineer, or create derivative works from the Service, except as permitted by law or with our written permission.

We love hearing ideas. If you send us suggestions or feedback, you agree that we may use them without any obligation or compensation to you.

Viewed is actively developed, so features will change. We may add, change, or remove features, or suspend or discontinue parts of the Service. If we make a change that significantly affects you, we’ll try to give you reasonable notice, for example on our updates page or in the app.

You can stop using Viewed at any time. You can delete your account in the app, where available, or by contacting us through our support page.

We may suspend or terminate your access to the Service if you violate these Terms, if required by law, or if your use creates risk or possible legal exposure for us or others. Where appropriate, we’ll tell you why.

Sections of these Terms that by their nature should survive termination will survive, including Your Content (to the extent described above), Our intellectual property, Disclaimers, Limitation of liability, Indemnity, and Governing law and disputes.

We work hard to make Viewed great, but the Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We don’t guarantee that the Service will be uninterrupted, secure, or error-free, that media information will be accurate or complete, or that recommendations will match your taste. Content posted by users reflects their views, not ours.

Some places don’t allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

To the fullest extent permitted by law, Viewed and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, goodwill, or use, arising out of or related to your use of, or inability to use, the Service.

To the fullest extent permitted by law, our total liability for any claim related to the Service is limited to the greater of the amount you paid us in the 12 months before the claim arose or US $50.

Nothing in these Terms limits liability that can’t be limited under applicable law, such as liability for fraud or for death or personal injury caused by negligence.

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Viewed and its operators from claims, damages, losses, and expenses (including reasonable legal fees) arising from Your Content, your use of the Service, or your violation of these Terms or anyone else’s rights.

These Terms are governed by the laws of the jurisdiction in which Viewed’s operator is established, without regard to conflict-of-law rules. If you are a consumer, you also keep the protection of any mandatory laws of the country where you live.

Before filing a claim, please contact us so we can try to resolve the issue informally. Most concerns can be sorted out quickly that way.

We may update these Terms from time to time. When we do, we’ll change the “Last updated” date above. If the changes are significant, we’ll give you notice, such as a post on our updates page or a message in the app, before they take effect.

If you keep using Viewed after the updated Terms take effect, you agree to them. If you don’t agree, you should stop using the Service and may delete your account.

If any part of these Terms is found to be unenforceable, the rest will remain in effect. Our failure to enforce any provision is not a waiver of our right to do so later. These Terms, together with the Privacy Policy, are the entire agreement between you and us about the Service.
